Car Accidents
For over two decades we have focused on cases involving vehicle collisions where our clients or their families have been injured or killed on the roadways and highways in San Diego and throughout California. Our dedication and skill in helping injured victims has helped us recover millions of dollars for our clients.
We never charge for the phone call an injured person or his or her family makes to our office to obtain legal advice and assistance. Our first order of business is to obtain the necessary information to determine what the specific facts are and determine if we can represent you. We look at the available facts in order to begin to assess liability or fault, we review the applicable insurance coverage's and other avenues of possible monetary recovery and consider the various laws which control the claims and timelines.
We will never take a case unless we feel you will benefit from retaining our office. We evaluate each case carefully because we operate on a contingency basis, which means that we do not get paid for the time and effort we put into your case unless you recover money.
If we are interested in representing you, we will set up on appointment to discuss the various options and we will carefully explain what you need to know and what actions you and our office need to take. We review all pertinent documents you have concerning the incident as well as our written fee agreement which clearly provides that if we do not recover money or monetary damages on your behalf we do not collect any attorney fees. You are not under any obligation to retain our firm.
As your legal representatives, we work to provide you the highest quality in legal assistance. We coordinate any needed medical care, medical assistance, medical benefits and insurance. We obtain insurance information and contact all involved insurance companies, insurance adjusters and parties. We obtain all needed documentation including witness statements, photographs, police reports, medical reports, bills, investigative reports, and photographs of the incident site, vehicle damage and injuries. We conduct an investigation, including an asset search on the person or entity which caused you harm. Our office ensures that the insurance company or liable party provides you any needed rental vehicle or that your vehicle is properly and timely fixed or replaced. Our job is to take care of all the necessary legal problems and details so that you can focus on getting better.
In most cases, after your medical condition has stabilized or has reached a point of maximum improvement, we evaluate all the relevant facts and applicable laws and send an extensive "demand package" to the appropriate parties and/or insurance companies which are in any way legally obligated to provide coverage or pay for your losses. The "demand package" outlines our position with respect to settlement and documents our position on liability or who is at fault as well as all damages you have sustained (loss of income, loss of future earning capacity, pain, suffering, disfigurement, loss of enjoyment of life, etc.) At that point, we often obtain a settlement of your case for an amount that is fair and reasonable and serves to compensate you for all of your losses.
If your claim goes to court, we have a vast amount of knowledge and experience needed to meet the unique demands of handling a motor vehicle related injury or death case in court. We understand the defenses used in order to try to defeat or minimize an injury claim and what is required including properly obtaining and presenting evidence including expert testimony such as accident recontructionists, life care planners, engineers, and economists in order to prevail and obtain the best possible outcome for our client.
Motorcycle Accidents
We ride and we know what it is like out there. An average of 2,000 motorcyclists are killed each year and another 50,000 injured in traffic collisions. More than 80 percent of all motorcycle accidents result in injury or death.
Most motorcycle injuries and deaths are not caused by the rider, but other drivers. More often than not even if the rider is partially at fault for the accident, other factors contributed outside of the rider’s control. Motorcycle accidents are usually so severe that there will still be a substantial recovery, even if the motorcycle driver was partially at fault.
Even more so than in other motor vehicle collisions, the insurance companies and their attorneys try to avoid responsibility by focusing on the other driver's field of vision and ability to have seen and reacted to the motorcycle.
A proper investigation is essential to any motorcycle accident. Issues such as fields of vision, road design, and mechanical functions are all items that have to be considered by both the attorney and the experts retained to assist the legal team.
In addition, the attorney must understand how to handle the bias that many people have toward people who ride motorcycles. When a case goes to trial, these issues needs to be dealt with head on at the earliest stages of jury selection. The bottom line is that you need an attorney who understands AND is experienced in the art of motorcycle accident litigation. An attorney who knows more than just the parts, but knows how they fit together, what they do, what can go wrong, and what you can get when you do it right.
